Terms of use

Welcome to Data Privacy Hub (DPH), a product developed and managed by 360workx. By accessing and using our platform, you agree to comply with these Terms of Use. If you do not agree, please refrain from using our services.

Introduction

DPH is a solution designed to automate and orchestrate data deletion across complex application landscapes, ensuring compliance with GDPR, CCPA, and other data protection regulations. It can function as a standalone product or integrate with metadata management tools.

Acceptance of Terms

By using DPH, you affirm that you are at least 18 years old or have obtained legal guardian consent. Your continued use constitutes acceptance of these terms.

User Roles & Responsibilities

DPH defines several user roles, each with specific permissions:

  • System Admin: Full control over system settings, user management, and overall operation.
  • Approver: Reviews and manually approves or rejects deletion requests.
  • Suspension Manager: Handles deletion suspensions based on legal/compliance requirements.
  • Operator: Executes deletion requests, manages errors, and ensures smooth workflow operation.
  • Read-Only User: Can view data deletion processes but cannot modify them.

Use of the Service

You agree to:

  • Use DPH only for lawful purposes and in accordance with applicable privacy laws.
  • Ensure that your data deletion requests do not violate any legal or contractual obligations.
  • Maintain the confidentiality of your account credentials and not share them with unauthorized users.

You may not:

  • Attempt to reverse-engineer, copy, or modify the software without permission.
  • Use the platform to delete data illegally or in a manner that violates regulations.
  • Interfere with the system’s security, attempt unauthorized access, or disrupt services.

Compliance with Data Protection Laws

DPH is designed to assist with data privacy compliance; however, users are responsible for ensuring that their data deletion policies align with GDPR, CCPA, and other applicable laws.

  • Audit Trails: All deletion actions are logged for auditability and compliance verification.
  • Error Handling & Reprocessing: The system enables automated replays for failed deletion attempts.
  • Scalability & Security: DPH leverages AWS Kubernetes, PostgreSQL RDS, API Gateway, and Kafka for secure, scalable operations.

Intellectual Property

All content, including software, logos, trademarks, and documentation, is the exclusive property of 360workx. You may not copy, distribute, or use our intellectual property without explicit permission.

Availability & Service Interruptions

We aim for 99.9% uptime, but we do not guarantee uninterrupted service. Downtime may occur due to:

  • Scheduled maintenance
  • Security patches and updates
  • Unforeseen system failures

Data Security & API Usage

  • Role-Based Access Control (RBAC) is implemented to restrict unauthorized actions.
  • API interactions are secured through authentication and rate-limiting to prevent unauthorized access.
  • PostgreSQL RDS encryption ensures data protection at rest and in transit.

Termination & Suspension

360workx reserves the right to terminate or suspend access if:

  • A user violates these Terms of Use.
  • Unlawful or unauthorized activities are detected.
  • There is a security threat to the platform.

Limitation of Liability

360workx is not responsible for:

  • Any legal consequences arising from a user’s non-compliant data deletion requests.
  • Loss of data due to user error, misconfiguration, or unauthorized actions.
  • Third-party system failures affecting integration with DPH.

Updates & Changes to Terms

We may update these terms periodically. Users will be notified of significant changes via email or platform notifications.

Governing Law & Dispute Resolution

These terms are governed by the laws of Switzerland. Any disputes shall be resolved through arbitration or courts in Zurich.
